§1 Acceptance and scope
By accessing or using the website datariders.com.br or any production agent (AquaTwin, ISO 14001, GISTM.ai, PAEBM.ai, TCM, TSM.AI, CMSI, SiteVisits.ai, RIDE Agent, Muiraquitãna, Data Riders Agent), you agree to these Terms. Commercial use of the agents is governed by a specific contract that prevails in case of conflict.
§2 Intellectual property
All content on the site (text, images, brand, code), as well as the agents' software, is owned by Data Riders or its licensors. Copying, modifying, redistributing or commercial exploitation without written authorization is forbidden.
§3 Acceptable use
- You will not reverse-engineer, mass-scrape, prompt-inject or attempt to jailbreak the agents.
- You will not use the services for unlawful purposes or to infringe third-party rights.
- You will not submit sensitive personal data without prior contractual authorization (health, biometrics, minors' data).
- Abusive behavior leads to access suspension without prior notice.
§4 Nature of AI & human accountability
Data Riders agents provide decision support. Formal opinions, gap analyses and action plans have a named human owner (qualified engineer) who reviews and signs them before publication. Conversational widget outputs and exploratory iterations are flagged as decision support and do not constitute a signed engineering opinion. The customer is responsible for validating and applying recommendations to their specific context.
§5 User‑submitted content
You retain all rights to the content you submit (documents, prompts, messages). You grant Data Riders a limited license to process that content solely to provide the requested service, per the retention rules described at /en/security-privacy/#data-lifecycle.
§6 Secondary use of data (benchmarks & improvement)
Industry benchmarks published by Data Riders are built exclusively from:
- (a) aggregated, anonymized public data (public GISTM/TSM/Copper Mark reports, ANM, ICMM, IRMA datasets);
- (b) client data expressly authorized by contract, always anonymized at the site level before aggregation.
We do not use one client's data to generate benchmarks consumed by another without written authorization. Tenant‑scoped continuous improvement (prompts, RAG rules, few‑shot examples) is opt‑in and isolated to the customer's workspace — it does not train the foundation model. See Trust Center §6.
§7 Availability
We aim for high availability but do not guarantee uninterrupted service. Maintenance windows are communicated with reasonable advance notice to clients under contract. Specific SLAs may be set in the SOW.
§8 Limitation of liability
To the maximum extent permitted by applicable law: Data Riders is not liable for indirect damages, lost profits or loss of data arising from the use of the site or from agent outputs that have not been validated by a qualified human owner per §4. In any event, total aggregate liability shall not exceed the amount paid by the customer in the 12 months preceding the event.
§9 Indemnification
You agree to indemnify Data Riders against third-party claims arising from your use of the service in violation of these Terms.
§10 Suspension and termination
We may suspend access for violation of these Terms or for non-payment. You may cancel at any time; contracted clients follow the contractual notice period.
§11 Governing law and venue
These Terms are governed by the laws of the Federative Republic of Brazil. Venue: Belo Horizonte/MG, unless a specific contract sets a different venue.
§12 Changes
These Terms may be updated. Current version: 2026‑04‑27 (G40). Material changes are communicated via banner and email to active clients.
